Nigerian Man Sparks Debate After Borrower Refuses to Pay ₦400k Interest on ₦5m Loan Despite Signed Agreement

A Nigerian man has stirred widespread reactions online after disclosing how a borrower allegedly refused to pay an agreed ₦400,000 interest on a ₦5 million loan, despite signing a written agreement beforehand.

According to the viral social media post, the borrower successfully repaid the ₦5 million principal but declined to pay the interest, arguing that the lender lacked the legal authority to enforce such a charge.

The borrower reportedly told him:

“He said I am not a licensed money lender and I can’t win the case if I drag him to court.”

The lender expressed frustration over the situation, explaining that the borrower confidently insisted he would not pay the agreed interest, leaving him uncertain about his legal standing.

Legal Opinions Divide Nigerians

The case quickly generated intense debate, with legal experts and social media users offering mixed views.

A legal commentator, Dammy Esquire, noted that the borrower could be partially correct under Nigerian law:

“He is partly correct. In Nigeria, charging interest regularly without a money lender’s license can weaken your case for the interest, even if the principal loan was repaid.”

However, he emphasized that the signed agreement could still hold legal value and advised the lender to seek professional legal counsel.

Another commentator, Mayokun, condemned the borrower’s actions, saying:

“He’s a thief who lacks integrity. Didn’t he know the office of licensed lender when he signed the agreement?”

He argued that if the arrangement was a one-time private loan rather than a formal money-lending business, the lender might still have grounds for a breach of contract claim.

Public Reactions Intensify

The incident has reignited conversations around:

  • The legality of private lending agreements
  • Enforcement of interest clauses
  • Moral responsibility in financial contracts
  • The role of licensing under Nigeria’s Money Lenders Act

Some commenters also warned that legal outcomes could vary significantly depending on interpretation and court handling.
