In the dispute over a plot of land at 49 Iyara Street, Warri South Local Government Area, the New Jerusalem Church of God, Victoria Parish Headquarters in Warri, Delta State, has won a court decision with a five million naira damage award in its favor.
The plot of land is 855.58 798.10 square meters in size.
The church specifically won the judgment in the lawsuit it filed against Mr. Tongbe Solomon Esinmaje, who started construction on a three-story building on land it owned but never finished.
Esimaje then brought the church before the Warri-based Delta State High Court 3 in an effort to purportedly assert ownership of the land.
The unfinished three-story building that was built on the Church’s portion of the land was demolished today in accordance with the judgment that was rendered.
Only after the church separately obtained a “Writ of Possession” against the claimant did the demolition exercise get under way.
Esimaje was fined five million naira by Justice N.E. Emudainohwo for trespassing on the property, building an unfinished storey building, and otherwise changing the character of the land “without the consent of the defendant/counter-claimant first sought and obtained.”
